This E-Consent Agreement ("Agreement") explains how Net Pay Advance, Inc. ("NetPay Advance," "we," "us," or "our") will provide documents and communications to you electronically. By agreeing to this consent, you acknowledge that you have read, understood, and agree to receive all documents and communications electronically as described below.
By providing your consent to receive electronic communications, you agree that we may provide to you electronically, through our website, email, text message, or by making available through your online account, any and all:
Legal Notices: Terms of Service, Privacy Policy, and other legal agreements
Disclosures: Truth in Lending Act (TILA) disclosures, state-specific disclosures, and other required notices
Account Statements: Payment confirmations, account summaries, and transaction histories
Communications: Account updates, payment reminders, collection notices, and customer service messages
Marketing Materials: Promotional offers and service updates (with your separate consent)
Your Right to Paper Documents
You have the right to receive paper copies of any electronic documents. See Section 6 for details on how to request paper copies.
2. Types of Electronic Communications
2.1 Email Communications
We will send important documents and notices to the email address you provide. You agree to:
Maintain an active, valid email address
Check your email regularly
Add our email addresses to your safe sender list
Ensure your mailbox has sufficient storage space

Documents may be made available through:

Posted on our website with email notification
Downloadable PDF files
2.3 Text Messages (SMS)
With your separate consent, we may send:
Payment reminders
Account alerts
Verification codes
Important notices
2.4 Mobile App Notifications
If you use our mobile app, you may receive push notifications about your account.
3. How We Deliver Electronic Documents
3.1 Delivery Methods
Documents are considered delivered when:
Email: Sent to your registered email address
Online Account: Posted to your account and you receive notification
Website: Posted on our website and you receive notification
SMS: Text message sent to your registered mobile number
3.2 Your Responsibility
You are responsible for:
Checking your email, online account, and text messages regularly
Promptly reviewing all communications from us
Downloading and saving important documents
Maintaining adequate storage for documents
3.3 Timing of Delivery
Electronic documents are considered received when they are made available to you, even if you do not actually access or read them.
4. Electronic Signatures
4.1 Consent to Electronic Signatures
You agree that your electronic signature has the same legal effect as a handwritten signature. Electronic signatures may include:
Clicking "I Agree" or "Accept" buttons
Checking consent boxes
Typing your name in a signature field
Using a digital signature pad
Any other method we designate
4.2 Legal Effect
Under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and state electronic signature laws, your electronic signature on any document has the same legal force and effect as a handwritten signature.
4.3 Record Retention
We will retain electronic records of your signatures and consents in accordance with applicable law.
5. Hardware and Software Requirements
System Requirements for Electronic Communications
To access and retain electronic documents, you must have:

Windows 10 or higher, macOS 10.15 or higher, iOS 14 or higher, or Android 8.0 or higher

Internet Connection:
Broadband connection recommended (minimum 1 Mbps)

Email Account:
Valid email address and email client or webmail access

PDF Reader:
Software capable of viewing PDF files (such as Adobe Acrobat Reader, available free at adobe.com)

Storage:
Sufficient storage space to save documents
✓
Printer (Optional):
Printer or ability to download/save documents if you want to retain paper copies
5.2 Responsibility for Equipment
You are responsible for:
Obtaining and maintaining all necessary equipment and software
Paying for internet access and any related fees
Keeping your systems updated and secure
5.3 Changes to Requirements
If our hardware or software requirements change in a way that creates a material risk that you will not be able to access or retain electronic communications, we will notify you.
6. Obtaining Paper Copies
6.1 Request Process
You have the right to receive paper copies of any electronic document at no charge. To request a paper copy:

6.2 Timing
We will provide paper copies within a reasonable time after receiving your request, typically within 10 business days.

You may request paper copies of documents for as long as we are required by law to retain them.
Important Note
Requesting paper copies does not constitute withdrawal of your consent to receive electronic communications. To withdraw consent, see Section 8.
7. Updating Your Contact Information
7.1 Your Obligation to Update
You must promptly notify us of any changes to:
Your email address
Your mailing address
Your phone number
Any other contact information
7.2 How to Update Information
You can update your information by:
Logging into your online account and updating your profile
Calling customer service at (888) 942-3320
Emailing us at customerservice@netpayusadvance.com
7.3 Consequences of Outdated Information
If you fail to provide accurate contact information or notify us of changes, you may not receive important communications about your account, and you remain responsible for all obligations under your loan agreement.
8. Withdrawal of Consent
8.1 Right to Withdraw
You have the right to withdraw your consent to receive electronic communications at any time. To withdraw consent, you must:
Contact us in writing via mail, email, or through your online account
Clearly state that you are withdrawing consent to electronic communications
Provide your name, account number, and contact information
8.2 Effect of Withdrawal
After you withdraw consent:
We will provide future communications in paper form by mail
The withdrawal does not apply to communications provided before the withdrawal
Your withdrawal does not affect the legal effectiveness of any electronic signatures or documents provided before withdrawal
8.3 Timing
Withdrawal of consent will be effective within a reasonable time after we receive your notice, typically within 10 business days.
⚠️ Important Notice About Withdrawal
Withdrawal of your consent to receive electronic communications does not terminate your loan agreement or relieve you of your obligation to repay your loan. You will continue to receive paper communications by mail.
9. Federal E-SIGN Act Disclosure
9.1 E-SIGN Act Requirements
The federal Electronic Signatures in Global and National Commerce Act (E-SIGN Act) requires us to inform you of your rights when we provide documents electronically.
9.2 Your Rights Under E-SIGN
Under the E-SIGN Act, you have the right to:
Receive documents in paper form
Withdraw your consent to electronic delivery at any time
Receive notice of any fees associated with withdrawal (we do not charge fees)
Receive notice of hardware and software requirements
Receive updated hardware and software requirement notices
9.3 Demonstrating Consent
By clicking "I Agree" or checking the consent box, you demonstrate that:
You can access information in the electronic format we use
You consent to receive electronic communications
You consent to use electronic signatures
